These terms and conditions govern the sale of products by Lagad Vision to you, our customer, on the lagadvision.com website. These terms and conditions constitute the entire agreement between Lagad Vision and you, our customer.
Please read these conditions carefully before purchasing Lagad Vision products. By ordering our products, you signify your agreement to be bound by these terms and conditions.
These Terms and Conditions are regularly updated. The applicable Terms and Conditions are the existing ones at the time of the order.

OUR CONTRACT
When you place an order on our website to purchase products from us, this constitutes an “Offer to Buy” from you.
Our “Order Confirmation” emails are to confirm that we have received your “Offer to Buy”. All orders are subject to our terms and conditions and we reserve the right to cancel or suspend your order based on these.
We accept this order when we send you an “Order Shipment” email confirming that we have dispatched the goods you have ordered from us. That acceptance will be deemed to be complete and communicated to you at the time we send the Shipment email, whether you receive that email or not.
You are an individual Consumer:
All products proposed to individual consumers by the website lagadvision.com are limited to Metropolitan France and some DOM-TOM (Martinique, Guadeloupe, Reunion).
You are a Business:
All products proposed to Business by the website lagadvision.com are limited to Denmark, Sweden, Norway and Finland.
PRICES AND PROMOTIONS
Prices are indicated in Euro (EUR) and do not include shipment costs. Freight costs are communicated to you, our customer, in the heading “freight costs” available on the website where all costs will be clearly specified in the total amount of the order prior validation.
Promotional offers are only valid according to the validity of the offer and available stocks.
The sales of the products will be limited to 12 identical products per day/per order and/or per person. Any order exceeding this number will be rejected and the supplier will be informed.
IMPORT DUTY AND VAT
Deliveries for France are dispatched from our France based warehouse.
Customers willing for their products to be delivered in the following DOM-TOM (Martinique, Guadeloupe, Réunion) might have to pay customs duties, Octrois de mer and other various taxes applicable by the territory of delivery to the products.
Deliveries for businesses located in Denmark, Sweden, Norway and Finland are dispatched from our Denmark based warehouse.
Prices in the shop are quoted net of import VAT, customs duty and other levies or taxes. As an importer of the goods into these member states, you are solely responsible for all import VAT, customs duty, other levies, tariffs or taxes and these may be payable on delivery of the goods to you.
WARRANTY OF CUSTOMERS
Lagad Vision will provide a product in conformity with our contract and is responsible for the defects existing when delivered. Lagad Vision is also responsible for the defects due to the packaging and when the products was packaged under its own responsibility.
In order to be in conformity with the contract, the products must:
- Be proper to be used according to the way this kind of products is usually used
- Correspond to the description made by the vendor
- Present the quality a buyer can expect according to the public declarations made by the vendor, particularly via advertisements and labels.
If you, our customer, think you received a product you think is in non conformity or with defects, you will have to fill the return form document available on the website.
Mediation regarding consumers litigation
Our Customers are entitled to get an access to a consummation mediator in order to get an amicable resolution of a conflict with a Professional if the litigation could not be solved amicably and directly with Lagad Vision.
RETURN OF THE PRODUCTS:
The Lagad Vision Customer Services will give you, our customer, the instructions on how to proceed after acknowledging the formulated claim. If the product is found to be not in conformity or with defects, Lagad Vision will either replace the product or reimburse the product within 7 days after the products have been duly received by Lagad Vision.
The return of the product must be made with the order number, in its original packaging and a carton fit for its transport.
OBLIGATIONS OF CUSTOMERS
You customer commit not to publish any advices or comments which could be negative, insulting, defamatory, illegal towards Lagad Vision and the products Lagad vision propose on the website or on any other means of communications, and especially Social networks.
If there is no respect of this clause, Lagad Vision can resiliate unilaterally these Terms and Conditions and intent a legal procedure vis a vis the Customer.
Customers also commit :
Not to use the Website in an illegal manner, for any illegal purpose and for any manner incompatible with these Terms and Conditions and any applicable regulations and laws.
Not to use abusively the discount coupons and/or to publish these on sites which do not belong to the Lagad Vision blogs and social networks.
Not to use the site for publishing, hosting, propagating, using, storing and managing abusive, defamatory, obscene, pornographic, harassing, threatening documents or any other fake documents which can also damage someone’s private life.
- To pretend to be another person or entity or not being honest with the way the user is affiliated with another entity or company.
- Not to communicate its password and leaving another person to get access to its own account and being careless with the safety of the password.
- Not to collect personal data regarding other users of the site in order:

- To intentionally forget or for not figuring its up to date details.

- To send and publish non authorised commercial communications on the website.

- To intimidate or harass other Customers

- To collect information regarding Customers or the content of what they publish and get access to the website via automatised methods ( such as Robots, Spiders, etc…) without the consent of Lagad Vision

- To try to get access to the IT system of the website or to process to any activity disturbing the quality or reducing the performances of the website.

- To use abusively of the website by using virus or any other malware and trying to get access to the site in an unauthorised manner.
Lagad Vision keeps the rights to suspend or resiliate the account of the Customer or to stop providing any of the products at any time for whatever reasons, especially if the company has got reasonable reasons to think that these Terms & Conditions have been violated or could present a risk to Lagad Vision.
QUALITY OF THE PRODUCTS
The products presented on the website are described with their essential characteristics. The description also includes the application recommendation.
The purchase, the usage of the products do not dispense the customer to see a medical doctor, or any health professionals whatever the symptoms or the needs.
Products cannot be used beyond their expiry date.
Products will require to be kept in an environment and a temperature as recommended on the website and/or the label.
Customers, before any use of the products and placing an order, must take note of the way to use the products and respect the mentions relative of the usage of the products.
Customers are informed that the products cannot be used and consumed in a different manner than what is described in the documents relatives to the products (especially recommended number of softgels/day and contra indications)

LIMITATION OF LIABILITY
Our liability to you for breaking any of these Terms and Conditions is limited to refunding any money you’ve already paid for items that you haven’t received.
We won’t be liable for any other loss or damages, unless the loss or damages are caused by our negligence or our breach of these terms and conditions.
We do not accept liability for any errors and omissions and reserve the right to change information, prices, offers, specifications and descriptions. We will endeavour to do our best to correct errors and omissions as soon as practicable after we become aware of them. We shall be under no obligation to dispatch an order for products/offers which have been advertised
Lagad Vision cannot be held accountable for damages of any kind, materials, non materials or injuries which could result from the wrong usage of the products by Customers.
If one of the products acquired is causing a damage to the User of the product, the User is invited to contact immediately the company.
The Customer is solely responsible of its Internet connexion and, before using the website, the Customer must make sure its IT system allow s a correct and safe access to the website.
The User must make sure the IT configuration of its equipment used to place the order is correct and without any IT virus.
Lagad Vision cannot be held responsible if the IT system of the Customer could reject emails sent by Lagad Vision and especially the copy of the payment proof, the state of the order and the email following the shipment.
OUR PROCESSING OF YOUR PERSONAL DATA
In order to process your order, the following may be required:
Your email address is stored so that we can send you an email to confirm that any orders, payments, dispatches and any other transactions entered by you have been successfully processed via our website.
We ask you for your telephone number in case we need to contact you about transactions on your account including orders, deliveries and payments. We may also telephone you to advise you of any Lagad Vision Products offers which we think may be of interest to you.
We may disclose your information to other companies and individuals who we appoint to undertake, on our behalf, services relating to the administration of your account e.g. fulfilling orders, delivering packages, processing credit card payments etc. We may also pass your information to professional advisors if we require advice relating to our administration of your account. Any such companies, firm or individuals may not use your information for any other purpose and are required to process the data in accordance with the relevant Data Protection legislation.
OUR USE AND PROTECTION OF YOUR PERSONAL DATA FOR MARKETING PURPOSES
At Lagad Vision we endeavour to carry out our marketing activity in a considerate, ethical and economic way and respect the consumer’s choice when it comes to receiving direct mail. Lagad Vision understands the value of our customers’ privacy and can assure you that our services are provided with the utmost respect for your privacy. Lagad Vision therefore guarantee not to sell or pass your personal data to any third party company.
Our direct mailings may from time to time incorporate information from reputable third parties advising you of products and services, which we believe may be of interest to you, however, you can be assured that we will not pass your details to any such third parties. This will be in accordance with the UK’s Data Protection legislation.
Lagad Vision may use your data to periodically send direct marketing brochures or email you with information on our latest news or product offers. If you do not wish to receive our brochures or emails you can unsubscribe to our service by emailing us at info@lagadvision.com
COOKIES
The company is using cookies
Cookies are used by Lagad Vision for a statistical purpose, in order to make the browsing easier and to personalise the information which appear to the Customer. For example, cookies might be used to save the password of the Customer to help him for each of his visit to the website.
The cookies set up is realised with the prior consent of the Customer who will be kept informed of their existence with a banner which will inform him that this consent is necessary for the Customer to be browsing the website.
By browsing on the website, the Customer consents for the set up of cookies on his IT device.
The Customer can refuse the cookies by amending the parameters of its own browser.

ORDER AND VALIDATION OF THE ORDER
The order takes a few steps: A summary of your order is available on the page “Your basket”. You can amend your choices. An information regarding delivery times is provided. The button “order” allows to go to the page “delivery information” where you can select the mode of delivery and the mode of payment. On this page, you, Customer are responsible for checking your personal details and the number of products being ordered. You declare your knowledge of the Terms & Conditions by ticking the appropriate box before clicking on the box “ordering”.
According to the mode of payment chosen, the Order will be considered as effective only if:
The payment is received by the Lagad Vision
Banking payment Centres concerned and anti-fraud systems gave their approval.
As soon and the Order is validated and the payment recorded, Your Order will be processed.
Lagad Vision can cancel an order from any Customers if there is a litigation related to the payment of a previous order.
An acknowledgment of receipt detailing the nature of the order will be sent to you via email. This acknowledgement of receipt details the amount invoiced and delivery information.
The Customer accepts the recording system of the order as a proof of the convention and its date.
If You, Customer, do not receive this acknowledgement of receipt, you will be able to contact the Customer Services via email: info@lagadvision.com
PRODUCTS AVAILABILITY
Your basket page summarise the availability of the products according to the ordered quantity.
On the Product Page :
A product declared « in stock” means that Lagad Vision dispose of at least one unit of the product concerned in stock at the time of the order. This information is updated when the Order is shipped (from Monday to Friday).
In case of a product which finally is no longer available, the Customer will be invited by Lagad Vision to choose another product or to be fully reimbursed.
PAYMENT
Purchases on the website can be made either in euros or Sterling, all taxes included at the time of the order. These can be made via:
The Payment Terminal used for payments uses the Safety Protocol HTTPS. No Banking information is stored with the Website Host.
SHIPMENTS AND DELAYS
The delivery time Lagad Vision will do its best to respect will be indicated in the email of confirmation of the order.
For the shipment of parcels in France, Lagad Vision uses the Colissimo service from La Poste. The Customer chooses one of the proposed options when recording his order.
The Tracking number of the product is sent via email to the Customer. The tracking number will be effective once flashed by La Poste. The average delivery time is two (2) working days.
The Colissimo Suivi is put in the letter box of the Customer or a third party (neighbour, concierge…). The parcel is flashed (recording of the barcode) by the Postman. The flashing of the product means the delivery has been performed. The information can be seen on the website coliposte.fr. If the parcel has not been received despite the coliposte website declares the parcel has been either delivered or delivered to a third party, the User is invited to enquire with the neighbourhood and to contact the appropriate service of La Poste and to make a claim by calling the 3631. Only after performing these procedure, the Customers will be able to contact Lagad Vision via email: info@lagadvision.com in order to know what to do next.
The Colissimo Expert avec Assurance is delivered against signature to the Customer, recipient of the parcel. The Customer is insured for the full amount of the value against loss or deterioration by La Poste. Any litigation regarding the delivery of the parcel will give way to an enquiry and might lead to another shipment of the ordered products by Lagad Vision.
The Colissimo Mon Commercant / La Poste offers the Customer the possibility for the parcel to be delivered in a Post Office or a local retailer. The collection of the product can be achieved upon the presentation of an ID document.
If the parcel is not picked up within the indicated period (except in the above case regarding parcels shipped according to the Colissimo simple procedure and marked as “delivered” or “delivered to a third party”) an enquiry will be held with the shipping company which can take a few days and sometimes a few weeks (5 to 30 days with La Poste). During this period no return nor reimbursement can be made.
Lagad Vision is doing its best to ship the Order to the Customer within the shortest time frame. Nevertheless the responsibility of Lagad Vision cannot be engaged if the non delivery is due to theft or fault of a third party. In these cases, the customer needs to contact the delivery company.
The Customer is warned that if the Customer wrongly pretends that the Order has not been delivered when Lagad Vision can demonstrate otherwise, Lagad Vision can resiliate these Terms & Conditions and can eventually start a legal action and ask for compensation.
If there is a shipment delay, Lagad Vision cannot be held responsible for it. Claims can be addressed directly to the shipping company (La Poste).
DELIVERY ADRESS
Products will be delivered in Metropolitan France and the served DOM=TOM (Martinique, Guadeloupe, Réunion) according to the address as indicated during the Order procedure by the User. It is up to the user to provide the company with all the necessary details for the appropriate delivery of the order.
The User is responsible for the name and address of the recipient. These must be precise, true and complete. The company won’t be able to be held responsible for a delivery return due to a mistake with the address or because of the impossibility to deliver to the provided address.
RECEPTION CONDITIONS OF A PARCEL
The cost of returning the products will be charged to the Customer.
As detailed in the paragraph “Delivery and delays”, a Colissimo suivi is delivered without the recipient signature. If the main recipient is not present, the shipping company might deliver the parcel in a Mail room, in a Goods Reception location, at a Reception desk, a Concierge or a neighbour.
A Colissimo expert is delivered to the recipient with a signature. If not present, the parcel will be delivered the following day or/and according to the message left in the letter box.
Colissimo La Poste never calls the recipient prior the delivery of the parcel.
If the parcel was left in the Post Office, the Customer will be able to take it within fifteen (15 days). Beyond this limit, the parcel will be sent back to Lagad Vision.
If the parcel is not picked up or if there is an unwillingness to accept the delivery, this does not give way to a right of withdrawal. If a non claimed product is sent back by the Post Office to Lagad Vision, Lagad Vision will propose a subsequent shipment of the products but the Customer will be charged for the freight cost of the subsequent delivery. The returned products will be required to be in perfect conditions in order to be sold again.
The Customer is entitled to refuse the delivery for the following reasons:
The parcel is open
The parcel is obviously damaged or crushed.
Once the damaged parcel is received by Lagad Vision, a new parcel will be delivered to the Customer without any new freight charges.
MISTAKES
The Customer must always check the parcel upon delivery.
All claims must be addressed to the Customer Services via email: info@lagadvision.com within fourteen (14) days from the date of the parcel delivery.
The freight charges will be brought by Lagad Vision if there is a mistake with the delivered products except if the delay mentioned above is expired.
DEFECTS
If there is an apparent defect with the products delivered, the Customer will receive a new delivery of the products after the defective products had been received by Lagad Vision.
CANCELLATION & REFUNDS POLICY
If you wish to cancel or amend your order you must contact our customer care team immediately, by sending an email to:
Please note that all emails are responded to within 48 hours on working days, so your request may not be actioned within enough time before your parcel has been dispatched.
Unfortunately, because we process all orders quickly to ensure fast delivery, we cannot guarantee that we’ll always be able to cancel or amend your order before it has been dispatched.
Any unwanted, unopened item(s) can be returned to us within 30 days of the delivery date for a refund or exchange.
We recommend that you obtain proof of posting from your local post office upon returning the item(s). Refunds will be processed once the returned item(s) are received back into our warehouse. The amount we will refund is the amount paid for the product(s); delivery costs will not be refunded. Products must be returned to the warehouse they were dispatched from.
The Customer will be fully reimbursed except for the delivery freight costs when the products are returned. These will remain at the charge of the Customer.
All returned products will have to be correctly protected, in a perfect state for resale with all other accessories such as leaflets. The products will be required to be sent to the indicated address with a copy of the invoice sent to the User via email.

Parcels which do not include any elements allowing to identify the sender (Order number, mail, name, address) won’t be accepted.
NO RIGHT OF WITHDRAWAL
The Customer acknowledges and accepts that no right of withdrawal can be applied in any of the following cases:
The Products have been opened and/or used by the Customer and is non returnable for hygienic or health reasons
The packaging has been damaged. The products cannot be marketed again.
The Product has been modified by the Customer.
PRODUCTS REVIEWS
Lagad Vision allows the Customer who bought any products on the website to give a review regarding the products. The Customer will have to be connected to his account. The only objective is to inform other potential Customers according to their experience of the products. This freedom cannot be abused in order to comment about any other subject than the products
The review with the first name or the chosen nickname, the town, the postcode and the publication date will be checked within 48 hours. The Author will be allowed to amend or suppress his review by requesting it to the following address: info@lagadvision.com. The author of the review won’t be able to be contacted by another User or companies.
Criteria for moderation will be mainly the respect of the laws and regulations and the relevance of the comments.
Any comments inciting racial hatred, insults, defamatory, advertising, political, abusive comments will be suppressed. Any negative comments regarding the website, the Company’s team or its policy will also be suppressed.
Orthographic and grammatical mistakes won’t be corrected.
Reviews will be kept for a period of 10 years.
Lagad Vision cannot be held responsible for the reviews of the Customers. Lagad Vision is not responsible for these reviews.
INTELLECTUAL PROPERTY
The name, brands, logos of Lagad Vision and all Lagad products are the exclusive property of the Lagad Vision.
No rights on any items of this website can be obtained by downloading any elements of the website. It is forbidden for the Customer to publish, edit, send, show, suppress and add anything to this website. It is also forbidden to take any elements of this website in order to make any work based on these elements.
Lagad Vision grants a non exclusive right to the Customer to use this website. This right is strictly personal and cannot be transferred to nay third party. This right is granted for the time of duration of this website.
This website can contain links leading to other websites which are not edited nor controlled by Lagad Vision which cannot be held responsible for anything related to these websites. These links cannot be considered as an acknowledgment of Lagad Vision for any elements which can be found on these websites.
All questions or comments related to these other websites will have to be addressed directly to the owners/Managers of these websites. No link towards Lagad Vision’s website can be created without the expressed, written consent of Lagad Vision.
ELECTRONIC COMMUNICATIONS

We reserve the right to make changes to our policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
EVENTS BEYOND OUR REASONABLE CONTROL
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your legal rights.
WAIVER
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
GOVERNING LAW AND JURISDICTION
If any of the clauses of these Terms & Conditions becomes null and void for whatever reasons such as a change of laws and regulations, this does not affect the validity of all the other clauses of these Terms & Conditions.
Your relationship with us is governed by and construed in accordance with the laws of England. You agree, as we do, to submit to the non-exclusive jurisdiction of the Courts of England.
LANGUAGE
These Terms & Conditions are written in English and French. If any doubt, the English version will be the valid version.
Nullity
If one of the clauses of these Terms & Conditions are declared null or void, all other clauses remain valid.
